Cyber insurance in Germany

Encrypted servers, stolen customer data, a payment diverted by a forged email. Cyber insurance gives a company two things: specialists who take over within hours, and the money to get through the weeks that follow.

Local policies for foreign subsidiaries

A cyber policy combines a service with an insurance. The service is an emergency hotline with IT forensics, lawyers and crisis communication on call around the clock. The insurance pays for restoring data and systems, for lost income while the business stands still and for claims by customers and partners whose data or systems were affected.

For a German entity the local element counts. A breach of personal data must normally be reported to the competent data protection authority within 72 hours under the GDPR, and in Germany that authority is organised by federal state. A response team that works in German and in the German time zone saves time when it matters.

Is cyber insurance mandatory in Germany?

No. There is no legal obligation to buy it. Management is, however, responsible for dealing with IT risks appropriately, and customers increasingly ask about cyber cover in supplier questionnaires and contracts.

What is covered?

Incident response

24/7 hotline, IT forensics, legal advice and crisis communication.

Restoration

Cost of restoring data, software and systems after an attack.

Business interruption

Lost income and continuing costs while systems are down.

Third-party liability

Claims by customers and partners, including defence costs.

Data protection proceedings

Legal costs in regulatory proceedings and the cost of notifying those affected.

Fraud and extortion

Depending on the policy: payment diversion fraud and extortion scenarios.

What insurers expect from your IT security

Cyber insurers ask before they quote. Typical minimum requirements are multi-factor authentication for remote access and administrator accounts, regular backups that are kept separate from the network and tested, timely patching and trained staff. Answers in the proposal form must be accurate — incorrect statements can jeopardise the cover.

Are we covered under the group’s cyber policy?

Group policies often include subsidiaries, but check whether the German entity is named, whether the insurer may cover German risks, whether the limit is shared across the group and whether the response service is available locally and in German. Where it is not, a local German cyber policy can be placed alongside or underneath the group programme.

What does it cost?

The premium depends on turnover, sector, the limit and the state of your IT security. Small companies with turnover of up to about €2 million often pay from roughly €500 to €2,000 net a year for limits between €500,000 and €1 million. Insurance premium tax of 19% is added; only a quote is binding.

FAQ

Frequently asked questions

Is cyber insurance mandatory in Germany?

No. It is voluntary. Customers and business partners increasingly expect it, and management is responsible for handling IT risks appropriately.

Does cyber insurance pay a ransom?

That depends on the insurer and the policy. Some policies cover extortion payments under strict conditions, others do not. In every case the insurer’s specialists first examine whether systems can be restored without paying.

Are GDPR fines insured?

Whether regulatory fines can be insured at all is legally disputed in Germany. Policies typically pay the legal costs of the proceedings and the cost of notifying affected persons.

What do insurers require before offering cover?

Usually multi-factor authentication, separate and tested backups, timely security updates and staff awareness training. Larger risks are assessed in more detail.
